NESTING EXPERT — END USER LICENCE AGREEMENT

Please read this agreement before installing Nesting Expert ("the Software").
By installing or using the Software you accept these terms. If you do not
accept them, do not install the Software.


1. LICENCE GRANTED

Subject to payment of the applicable fee, you are granted a non-exclusive,
non-transferable licence to install and use the Software on the number of
computers covered by your licence key.

You may not redistribute, resell, rent, sublicense, or publish the Software,
nor remove or alter any notice contained in it.

Evaluation without a licence key. If no licence key is activated on your
computer, you may use the Software in evaluation mode. Evaluation mode has
the features of the Software's highest edition (Pro, where Basic and Pro
editions exist) and has no time limit, but it produces at most five (5)
outputs. What counts as one output is stated in the product documentation.
After the fifth output you may continue to use the Software, but it produces
no further outputs until a licence key is activated. The Software does not
change or disable outputs already produced. You may not reset the evaluation
count or extend the evaluation limit. The evaluation count is kept on your
computer, and the Software does not send it anywhere.


2. RESERVED RIGHTS

The Software is licensed, not sold. All intellectual property rights in the
Software remain with the author.

You may not reverse engineer, decompile, or disassemble the Software, except
to the extent that applicable law expressly permits this despite the present
limitation.


3. NO WARRANTY — READ THIS SECTION

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR
IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY,
FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

The Software produces nesting layouts, cutting files (DXF) and cost figures.
These are PROPOSALS AND ESTIMATES. The user remains solely responsible for:

  - verifying every layout before cutting,
  - verifying that the cutting parameters (tool diameter, part gaps, edge
    margins, bridges, keep-out zones) match the actual machine and material,
  - verifying quantities, material and thickness,
  - all costing and quotation decisions.

Sheet material and machine time are consumed irreversibly. Always check the
cutting report and the DXF before starting a cut.


4. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, the author shall not be
liable for any indirect, incidental, special or consequential damages, nor
for loss of profit, loss of material, machine downtime, scrapped parts or
delivery delays, arising out of the use of or inability to use the Software.

In every case, the total liability of the author is limited to the amount
actually paid by you for the licence during the twelve (12) months preceding
the event giving rise to the claim.

Nothing in this agreement excludes liability that cannot be excluded by law.


5. DATA

The Software runs locally on your computer. Your CAD models and nesting jobs
are not transmitted anywhere by the Software.

Licence activation and update checks contact the licence server and transmit
only the licence key and a machine identifier.

Settings are stored in %APPDATA%\NestingExpert.


6. THIRD PARTY

SOLIDWORKS is a registered trademark of Dassault Systèmes SolidWorks
Corporation. The author is not affiliated with, endorsed by, or sponsored by
Dassault Systèmes. This Software is an independent add-in.


7. TERM

This licence is effective until terminated. It terminates automatically if
you breach any of its terms. On termination you must uninstall and destroy
all copies of the Software.


8. GOVERNING LAW

This agreement is governed by the laws of the Republic of Türkiye. The courts
of İzmir shall have jurisdiction.
